Udeze, expelled member lack constitutional rights to represent us before INEC, Action Alliance cries out
By: Austine Agbo Emmanuel, Kaduna
http://www.newsportng.com.ng The Action Alliance (AA)has taken a swipe at a former member of the party, Mr Kenneth Udeze for allegedly misinforming the public and the Independent National Electoral Commission (INEC) in particular on issues that affect the party.
This was contained in a statement issued by its National Publicity Secretary, Comrade Olu Omotoso, and made available to the media today.
The statement stated that Udeze, having been suspended and subsequently expelled from the party, lacks the moral and constitutional rights to represent the party or speak on its behalf.
The leadership of the party also expressed concerns on why the Independent National Electoral Commission (INEC) could give recognition to an expelled member of the party and failed to recognize the authentic national chairman of the party, Hon Adekunle Rufai Omoaje whose election was held at the last national convention of the party held in Abeokuta, the Ogun State capital was supervised by INEC as provided by the constitution.
The party noted that the electoral body erred by giving undue recognition to Udeze despite furnishing it (INEC) with all the court judgments that affirmed the expulsion of Udeze.
The party recalled that the Federal High Court sitting in Abeokuta, the Abuja division of the Court of Appeal and the Supreme Court had all affirmed the expulsion of Udeze, stressing that the recognition given to Udeze by INEC amounts to contempt of court.
Reacting to a recent statement issued by Udeze where he apologized to INEC on behalf of the AA, the party stressed that the statement was a mere vituperation as Udeze is not a member of the AA and as such lacks the right to speak on behalf of the party, saying that the AA has a structure through which it operates.
Omotos,o who spoke on behalf of the party, y alleged Udeze of impersonation as his claim to be the national chairman of the party was said to be an impersonation and thereby called on security operatives to investigate Udeze and, d if found culpable,l,e prosecute him for allegedly impersonating the national chairman of the party.
Omotoso said,d It just came to the notice of the authentic National leadership of our party, Action Alliance,e that the meddlesome interloper, Kenneth Udez,e continues to parade himself as National Chairman of our part; this is despite the ruling of the highest court in the land. It beats our instinct how the commission continues to relate to him in deviance of court verdicts.
“To state clearly, however, our party, the Action Alliance,e has no plan to blackmail anybody as claimed by this persona non grata usurper, not even the INEC Chairman. What we do and continue to do is burst the intrigues of this interloper for the commission to see through his criminal antics of deceiving the leadership of the INEC to believe he is the chairman of our part while hiding court judgments against him from the commission.
“To set the record straight. Kenneth Obidiche Udeze is not even a member of our party, Action Alliance, let alone being the chairman. From the Federal High Court, Abeokuta, to the Court of Appeal sitting in Ibada, and to the highest court in the land, the Supreme Court, the suspension and ultimately the expulsion of Kenneth Obidiche Udeze has been affirmed,d and till no,w that legal affirmation has not been set aside. All of these judgments and many preceding them were filed with the commission through processes.
“We are,e however,r appalled at the reason why the commission continues to relate to a non-member of our party as being the national chairman.
“In disconcerted lies scripted and sent to the commission by this meddlesome interloper, he opined that an appeal he filed with the Supreme Court (so covertly that was also struck out against him in 2022, has now become a judgment in his favor. Prof. Yakubu and INEC leadership need to be more circumspect in dealing with this agent of deceit.
“By our understanding, INEC is a creation of the laws of the land, we believe it should run by the dictates of the same laws of the land. We expect that with the number of legal minds on the payroll of the commission covered by taxpayer’s money, the leadership of INEC should have the most brilliant legal advice that any agency of government could muster. We are aware of the unquestionable dept of the knowledge of our laws on the part of the legal team of INEC, quite a number of them Senior Advocates, hence Prof. Yakubu has no tenable reason whatsoever to claim not to know the position of the law about the truth about the leadership of our party, Action Alliance.
“Kenneth Udeze has no locus standi to speak, represent, or even appear anywhere on behalf of our party Action Alliance, being not a member of our party,” Omotoso added.
